It's pretty hard for any hero to be cool when they're held down by  a company that routinely decides to place the hero in the same box. Warner Brothers has been Superman's kryptonite for years because they refuse to let the Superman franchise flourish instead they let the Donner era dictate everything despite the fact that it's outdated. When Warner Brothers finally decides togive Superman better material to work with, the character will work because Warner Brothers is the common denominator in all of this.

Arkham has been decimated at the hands of Ra's Al Ghul, Bane and now Black Mask, I don't see the point in rebuilding a place that's destined to get blown up again. None of these inmates are ever going to be cured of anything. Aside from that, I believe the "Arkham becomes hell on Earth for the inmates" angle was already covered in Alan Grant's Shadow of the Bat.

I think the Marquis of Death is really Reed Richards from an alternate reality, which best explains why he didn't take out Reed like he did with Dr. Doom. I think the irony of Dr. Doom's master being an alternate version of his archenemy is something Millar would go with.

The Joker is all about getting inside Batman's head, he wants to be the winner in the psychological warfare that they have. The Joker knows Batman takes everything seriously because he wants to stay focused, so the Joker will do everything he can (refer to Batman in demeaning names, inappropriately touch Batman and etc) to throw Batman off his game. If the Joker were gay, he would make it well known. If the Joker were all about women, he would make it well known. Ultimately, the Joker is like Batman when it comes to sex in that it's not his primary goal whereas bringing the chaos to Batman's order is.

I think the Joker would be more attracted to Daredevil than Spider-Man for the whole "straight man" comic routine.
