    NEW RELEASE - ACTUALLY AN "UNRETIREMENT"!

    As you are all aware, the issue of public domain verification has caused more than a few problems and frustrations, but in this case, access to better information is a blessing.

    A while back we published A JOHNNY DYNAMITE TREASURY, adventures from the great 1950s Charlton series. I was contacted by someone who claimed that they owned the copyright, and because I could not dispute it and had no reason to, I removed the book out of respect.

    I have learned since, through multiple sources including the Library of Congress itself, that while this person did indeed buy the rights to the character, the copyrights for the original stories were not renewed and are therefore public domain. These stories had already fallen into public domain when the character was negotiated (although this is not the critical point, since renewal was required regardless) were already public domain when the rights were purchased, or whether they fell into public domain later on – but in any case these stories have been confirmed to be public domain.*

    As you know, we are adamant about respecting copyrights, and only publish books we are certain are public domain. If the person who controls the character has documentation that shows a renewal of copyrights, I will pull the book – but since I have searched the LoC database, that seems unlikely.

    Out of respect for trademark I have changed the title to WILD MAN FROM CHICAGO.

    *While these stories are public domain, it is incorrect to assume that the character itself is PD, since someone does own the rights to original stories of this character. It is incorrectly shared online that if the first appearance of a character is PD then the character is PD. This is not true in every case. The first appearances of Archie are PD, but is you try to launch an Archie comic, you are violating trademark. Ditto Tarzan, ditto thousands of other characters. Trademark and copyright are separate issues. Life is never that simple.
