How can DC sue Marvel over Blunder.. I mean Wonderman?

It isn't the first time that Marvel & DC created characters with the same name.  Remember Captain Marvel?  But no one remembers anoyone else called Wonder Man except the Marvel version.  I guess there's not much legal standing if they hadn't used the character for decades.

I remember a single panel in a 'What If?' or 'What the?' that asked "What if Wonder Man was a Woman and Power Man was a Girl?" but it just had pictures of a female versions of Simon's green costume and Luke's purple pants and yellow shirt. Heh.
