If they do end up trying to evict him, he could probably just pick it up and put it on the moon or something. Also, it isn't even the UN who are demanding to investigate the fortress, it's the US government, and I am pretty sure that it's out of their jurisdiction.

I don't think that's technically possible, because NO ONE owns Antarctica. But hey if the government or the UN wants to fight with Superman. He would have to go through the polar bears first. I don't think they want to kill an endangered species, do they? lol @g_man

I thought the Fortress of Solitude was at the NORTH pole. and in that case is it not on canadian land? They canadian government might care someone has a super powerful fortress on our land, but we don't have the man power and resources to try to take it.

Come to think of it, shouldn't Kryptonians be protected as an endangered species, since their home got blown all to hell, and you can count the remainder on one hand?

This is a stupid argument because the fortress is his home, well sort of. No force on Earth could evict him from the fortress. The governments of Earth could certainly make a pest of themselves but they are no real threat. I hope Supermen might use the technology in the fortress and make it invisible, move it under the ice away from prying eyes, or something like that. I really hope this does not become a major plot point.

Assuming he's in a common law jurisdiction (say, Canada or the United States), he could potentially have ownership by adverse possession. Difficult to say because it's not clear what state the Fortress is in, though a few other states have adverse possession rules.

Under most adverse possession laws, Superman would have to enter the land and have exclusive possession (check), must use it continuously for the statutory period (as a regular owner would) (check, probably), the entry must be open and notorious, and his possession must be adverse and under a claim of right. The big potential problem here is the "open and notorious" part. Not many people know about the Fortress of Solitude, that's kind of the point. But since it's likely wilderness area, I'm pretty sure building the Fortress itself rises to meeting that requirement.

Finally, if this land is actually owned by the government, good luck adversely possessing it. That's usually not allowed.

He can't be evicted if no one has official claim to that land then superman in turn has officially laid his flag on the land claiming the land as his plus the fortress is his property it doesn't belong to anyone else he doesn't have a mortgage on it he owns 100% of it and possession is as they say nine tenths of the law

Yes, he could be evicted and being that he is an alien any structure he builds on earth not sanctioned by a human government could be considered an act of war. Most likely the fortress of solitude is the region North of Alaska which is considered to be american territory and Lois Lane's dad would evict him from it If he had support from the current government especially if the current government had a strong anti-alien agenda.

@askanison295: You say that like humans are the only sentient beings allowed to build and prosper on this planet. Also, if he built the Fortress on the part of the North Pole that is unclaimed, then it becomes his property, possibly his own (unrecognized) country if he were to write a constitution.
