    Will Eisner's legendary newspaper comic creation was Denny Colt, a police detective that took on the identity of the masked vigilante, The Spirit, upon seemingly being resurrected after his death.

    So...Apparently The Spirit is in public domain.

    It seems to be a bit complicated, but as far as i can tell, yes, since there doesn't exist any evidence that Eisner ever renewed the copyright on the Spirit.
