Just because he wouldn't be forcing himself on her doesn't automatically mean it wouldn't be rape. No different than if someone snuck into a woman's house in the middle of the night pretending to be her husband and had sex with her that way. She believes she's having sex with her husband, but it's someone else... making it rape.
