This has always bugged me. There have been so many people to take up the guise of Spider-Man other than Peter Parker but there are all from other realities. Like Miguel O'Hara, Spider-Man of the year 2099 (Earth 928) or Max Borne, Spider-Man of the year 2211 (Earth 9500). Even Miles Morales as the new Spidey from the Ultimate universe (Earth 1610). You could even argue Mayday Parker is carring the legacy of her father as Spider-Girl and who know's, maybe even Benjy Parker will become Spider-Man one day (Earth 982). So does all of this count Spidey as a legacy hero of not because they are from different realities?

Peter Parker was bitten by a radioactive spider as a teenager, granting him spider-like powers. After the death of his Uncle Ben, Peter learned that "with great power, comes great responsibility." Swearing to always protect the innocent from harm, Peter Parker became Spider-Man.
Is Spider-Man a legacy hero?
Even in the regular 616 universe, Spider-Man has a legacy unlike any other hero. My answer is a definate yes, the legacy of Peter Parker cannot be denied.
Heroes come and go. A symbol is forever. And while he may not save the Earth or the world as often as other heroes, Peter still has given rise to a symbol that inspires hope. That symbol has been polluted, mocked, and insulted time and time again, yet it still inspires hope in the Marvel Universe. And if it inspires hope, then there will always be someone to use that symbol to inspire others. Yes, Spider-Man is a legacy hero. Not because other heroes imitate him, or take his name. He is a legacy because those who aren't heroes, those who pray to be saved when the walls come crashing down, believe those prayers answered when they say that symbol. And it's the stories of those people that will live on in history. It's their stories that will form his legacy.
So... yes. Yes he is.

I couldn't have said it better myself. Peter is a great character, but in the Marvel Universe(s), Spider-Man will live long past Peter's tenure. He's created a symbol of hope that's everlasting.

Definitely,when you have other super heros saying one of your catchphrases " With Great Power..." you know you're never going to be forgotten lol.
isn't a legacy character a hero or villain whose mantle passes down to a "next generation"?
From what i recall, Peter Parker has never given his name or his suit to anyone else to continue the legacy... they always either stole it, or it was given to them by someone else
so no... Spider-Man is not a legacy character
@Hunter114: He did let Ben Riley take over as spider-man before norman came back.
That was only because he believed that Ben was the real Peter Parker.
