The superhero crew for UA 2 is mostly released now and it looks like the answer is no (and I regret this answer I have to say)

The problem is the rights to use Punisher. They wanted to put him in M:UA1, but Punisher was owned by a different company and they weren't making any deals... so they ended up giving his move-set to Nick Fury.

There is a certain issue I have with characters that cannot truly be represented in a proper way.  Punisher is one of those characters, as well as Elektra.  With Iron Fist, Wolverine, DareDevil, Captain America, and (possibly) Black Widow, there are going to be way too many characters with the same premise for their abilities, and that would lead to someone being a random redundant add-in.  The last Marvel Ultimate Alliance almost made me shoot myself in the foot with how many unneccessary brawlers were in there.  Punisher should be off killing people in brutal ways, and Elektra deserves more than just a two sai attack leading to an uppercut.  Good action for a game of their own potentially, but with a cast as popular and detailed as the one we have so far, it seems like someone is going to end up being  "That" character.  "

He should be, couldnt believe he wasnt in the first one, or that he was left out of the DLC

Detective I don't really know what console's  no mercy's gonna be on but they should be next gen ...if  I'm not mistaken.
