Actually the Joker had a cameo in the very first episode. Not as the Red Hood or even in white skin and green hair. Lost yet? The Joker is never given a real name in comics. But go back to The Killing Joke where he paralyzes Barbara Gordon. His back story is of a struggling comedian with a pregnant wife. Since comedy doesn't work, he's tricked into being the Red Hood. He comes across Batman and falls into a chemical vat that causes him to become The Joker.
In the first Gotham episode Fish Mooney is auditioning stage acts; one of them is a struggling comedian that she actually likes. My theory is that failed comedian is The Joker. Therefore making him and Penguin two separate entities on the show. But there's no way we will see The Joker until after Bruce becomes Batman.
I thought that guy might more likely be Scarecrow, as his jokes seemed to be on death or fear
Isn't the Joker about death and fear? He didn't come across as scary when he did comedy in the one-shot or in the tv cameo.
