It's not a very Merry Christmas for Warner Bros.  Variety reported that a surprise ruling was made in favor of Fox.
A Los Angeles federal judge has ruled that 20th Century Fox owns the distribution rights to "Watchmen," representing a setback for Warner Bros.' plans to release the pic in March.

“Fox owns a copyright interest consisting of, at the very least, the right to distribute the ‘Watchmen’ motion picture,” the ruling said.

Judge Gary Allen Feess issued the surprise ruling Wednesday -- a week after setting a Jan. 20 trial date for Fox's suit -- and indicated he would issue a more detailed ruling soon. Warner spokesman Scott Rowe declined to comment.

I guess we'll have to wait to hear what will result from this.  The movie is finished.  Will Warner Bros. be willing to give up the release of the film after all the money they invested or will they attempt to make a deal with Fox and give them some of the profits?  I still find it surprising that it's come to this at this point.   Looks like Fox played their cards right in waiting until Warners finished production.

If I remember correctly this was never about profits.  I'm pretty sure Fox didn't want a piece of the action, they wanted the project to die.

Just a note, Methos has posted this in the boards about the same time I posted it in the news.  I saw there were already a couple comments on his thread so I didn't set this to go the boards.  By the looks of it now, another staff set this story to go to the boards.  Either way, we're all pissed.  Maybe some lone Fox Exec will see one of these threads and help do the right thing.  Maybe not.

Whatever the case, I don't think the movie is completely done for.  Warners will either try to appeal the case (which would delay the March 6 release) or they'll try to work out a deal with Fox (meaning sharing the profits).  I know some have mentioned that Warners wouldn't want to share profits just to spite Fox.  Watchmen had a $120 million budget.  The movie could come close to making that opening weekend.  The movie will definitely be profitable.  I can't see a studio refusing profits, even if they had to share them.  It doesn't seem Fox should get any since they pretty much just sat back and waited until production was finished.  But it does seem they have some rights.
