For his refusal, he was stripped of his title and imprisoned in Impel Down's Level 6 with Portgas D Ace, who was now one of Whitebeard's division commanders. The coming war was over his scheduled execution. During their incarceration, Boa Hancock came to see Ace and whispered to him that Luffy, Ace's younger brother, had slipped into the jail to save him.
Luffy arrived too late to prevent Ace's transfer to Marineford, but Luffy freed Jimbei and Sir Crocodile to break out of Impel Down. They fought through the various levels of the prison complex, and Jimebi aided in capturing the Navy Vessel the group used to escape and head for Marineford.
Too late to stop the war's beginning, Jimbei joined Luffy in trying to save Ace from execution. Jimbei fought with Gecko Moria, since he knew the weakness of Moria's zombies; and he helped launch Lufy over the barricades to get closer. Though Ace was freed, he was killed when he shielded the exhausted Luffy from an attack by Admiral Akainu. Luffy had gone catatonic from grief, and Jimbei fought to shield him form Akainu's pursuit. In their attempt to escape, Akainu used his magma powers to pierce through Jimbei and hit Luffy in the chest.
The injured pair were taken aboard the Heart Pirates submarine, to have their injuries treated by Trafalgar Law. Jimbei's wounds were tended to, but Luffy was still in peril. They all met out at sea with Boa Hancock and Emporio Ivankov. They decided to leave for Amazon Lily so Luffy could rest.
