    How is it that he is killed by Batgirl in issue 21 but in Suicide Squad 21 & 22 he's alive and working for them?

    Because he isn't actually dead but everybody believes he is and Barbara feels extremely guilty for it. That's why she removed the bat symbol from her costume because she doesn't feel worthy enough to wear it.
