Woman sues ALL homosexuals on Earth in Nebraska federal court

Who says life cannot imitate art? In Daredevil#7(April 1965), Prince Namor of Atlantis hires attorney Matt Murdock to sue all of humanity for wrongs allegedly done to his kingdom and its people by "surface dwellers"(said suit presumably in federal court) only to have the judge say that his suit is without merit because there is no polity that legally represents all of humanity.( The United Nations might be said to represent humanity as a collective group but the UN of course is NOT a nation state. Namor should have tried the International Court of Justice at The Hague or if the story was published today the International Criminal Court but I digress here)

Fast forward fifty years and we discover that a Nebraska woman Shirley Anne Driskell has filed suit in local federal court not just against local gays or even those in just her state alone or even in the United States but homosexuals as a class worldwide. Ms Driskell , who claims to represent Christ as an ambassador(question: who bestowed such a position on her?) says that her faith indicates that homosexuality is a sin.

Another question: does Ms Driskell seriously believe that "homosexuals" are a monolithic social and political group with a "hive mind"?

Five'll get you ten that his lawsuit will be laughed out of court as being both"frivolous" and "politically motivated"( the very same charges made against the ICC by the Bush Administration).

In the U.S. state of Nebraska, State SenatorErnie Chambers filed a suit in 2008 against God, seeking a permanent injunction against God's harmful activities, as an effort to publicize the issue of public access to the court system.^[1] The suit was dismissed because God could not be properly notified, not having an address. The Judge stated, "Given that this court finds that there can never be service effectuated on the named defendant this action will be dismissed with prejudice".^[1] The senator, assuming God to be singular and all-knowing, responded "The court itself acknowledges the existence of God. A consequence of that acknowledgement is a recognition of God's omniscience ... Since God knows everything, God has notice of this lawsuit."^[1][2] Chambers filed the lawsuit in response to another lawsuit that he considers to be frivolous and inappropriate.^[3]

In response to Chambers' case, two responses were filed. The first was from a Corpus Christi lawyer, Eric Perkins, who wanted to answer the question "what would God say".^[4] The second was filed in Douglas County, Nebraska District Court. The source of the second response, claiming to be from God, is unclear as no contact information was given.^[4]

On July 30, 2008, local media sources reported the Douglas County District Court was going to deny Chambers' lawsuit because Chambers had failed to notify the defendant.^[5] However, on August 1, Chambers was granted a court date of August 5 in order to proceed with his lawsuit. "The scheduling hearing will give me a chance to lay out the facts that would justify the granting of the motion," Chambers was quoted as saying. He added, "Once the court enters the injunction, that's as much as I can do," he said. "That's as much as I would ask the court. I wouldn't expect them to enforce it."^[6]

However, a judge finally did throw out the case, saying the Almighty was not properly served due to his unlisted home address.^[7] As of 5 November 2008, Chambers filed an appeal to the Nebraska Supreme Court.^[8] The former state senator John DeCamp and Oskar Augustsson in Sweden both asked to represent God. Augustsson's letters, mentioning the Bjorn Socialist Republic (a fictitious absurdist micronation), were stricken as "frivolous". The Appeals Court gave Chambers until February 24 to show that he notified DeCamp and Augustsson of his brief,^[9] which he did. The case was finally closed on February 25 when the Nebraska Court of Appeals dismissed the appeal and vacated the order of the district court. The court quoted cases according to which "[a] court decides real controversies and determines rights actually controverted, and does not address or dispose of abstract questions or issues that might arise in hypothetical or fictitious situation or setting".

This Woman is Stupid... Does she not know that the same faith that says that Homosexuality is an Abomination also says that eating Shellfish is an Abomination in the very same book in the Old Testament ( Leviticus ). This woman is overestimating the power Nebraskas federal court has worldwide. Also what crime does she say they commited? The go against her religious believes and are sinners. That doesn't even translate to illegal action. There is no existing law that says things going against relgious belief or homosexuality are a crime... Actually, there are plenty of laws who say that, but not in the USA.

People file frivolous lawsuits all the time. It's not shocking. She's exercising her right to do whatever the hell she wants. The problem would be if it were to be taken seriously. I'd be surprised but mostly p_ssed off if a hearing was granted as that's a waste of court's time which is paid by the public.

I originally presumed Driskell meant male homosexuals and not lesbians/bisexuals.. Apropos of the issue of jurisdiction may I cite"United States ex rel Gerald Mayo vs Satan and His Staff, 54 F.R.D 282"(W.D. Pa 1971) ln which the court observed that it was doubtful that the court could assert personal jurisdcition over the defendant and anyway the plaintiff gave no instructions as to how service of process might be perfected( cited in James Daily and Ryan Davidson's "The Law Of Superheroes", Gotham Books, 2012, p.144).
