Yes whoever is making a copy then uploading is stealing. But since you download already stolen then what difference does it make, it does not make any. Obviously everybidy wants to get paid but if You download you do not steal. You simply watch for free. If i see a movie on somebodys tv throug my window do i steal it?? No. I watch for free but that does not make me a thief

It's not likely you get caught for downloading from Piratebay but It's the creator of the site who will pay the price, which is many million dollars.

It's both. You're stealing it by posting it online without the consent of the company behind the file but then you're sharing it with others so they can have a free/cracked software as well.

Because in accordance to the very definition of stealing when you steal you deprive somebody from possesion of stolen object. making a copy of a digital goods do not deprive from possesion Beacuse because They do not run out, their number is limitless

If You take something from a person, that person does not have it any more, right? If You copy something that does not run out of stock ( by copying You do not take, You create new one based on the original ).

For example

Guy has a bread which I take and he does not have it any more - stealing

Guy has a breat wich I copy, he still have it and now I have it too..

Obviously watching movie without paying is not cool but it is not stealing.

Once again by the very definition of stealing, making a copy is not stealing. Were You allowed to make a copy? No. Were You allowed to share that copy? No. But did You steal? No

By the definition of stealing making a copy is not stealing, it is still illegal but not stealing.

If I copy Your dvd, You no longer have it? You do have it, now I have it as well, I did not steal I just made a copy unathorized but did not steal.

If I buy a plant and it grows and produces "seeds" and I plant those seeds, or give them away, or sell them, is that stealing? Do I owe the Home Depot money for using the seeds that were produced from their plant?

Do You want to know why it is called stealing even when it is not in fact stealing? Because it has bigger impact on people minds. It implies that once You stole, they no longer have it, but since its a digital copy and You did not take it away from them, You just created one more it is not stealing. In order to steal, You must take it away not just make unauthorized copy.

Making unathorized copy = usurpation

However downloading is not stealing, it is not even usurpation, hell in most countries its legal no matter what You download. It is not legal to upload, but it is legal to download as long as You do not share it with other people.

It is like finding money on the street, they are not Yours so what did you steal it now? You just picked something up that was already there ( movie on the internet ). Sure its not cool and all, but downloading is legal, sharing isnt.

The problem with torrents is, You cannot download without uploading, even if You upload 1kb You are sharing and that is not leagal = usurpation. But if You download the same movie from some link on the site ( regular dowanload, no sharing ) it is fine. You can do that, You are allowed to do that. What You are not allowed to do is to pass it on.

You can disagree if You like but thats how the law works...

Simple. To take ( in case of stealing ) means You take something from person A, and person A does not have it any more because You took it.

You cannot "take" digital movie because it is not an object. You can copy it and copying =/= taking it.

Now:

  • sharing - not leagal
  • downloading and sharing - not leagal
  • downloading and not sharing - leagal
  • watching downloaded movie - leagal
  • sharing downloaded movie - not leagal

If downloading form direct ( not torrents ) links or watching online IS leagal and stealing IS NOT leagal how can it be stealing, it is not cool and all fair but its not stealing. It is not... It is often called like that to make an impression and enforce actions by companies that own rights to them. By neither by the definiton or by the law is downloading ( when You do not share at the same time ) considered stealing.

The definition of stealing makes no distinction between whether on not the victim of theft has copies of their material(s), all it says is that

  • You have their property
  • You have no legal right to it
  • You have no intention of returning it.

Torrenting and most forms of Piracy fits this description; It's stealing.

And copyright laws have nothing to do with downloading, because it says copy right. SO You cannot make a copy but You can download ( legal )

Buying the seeds makes them and what they produce your property, that's not the same as buying copy righted materials. You only own the right to view, not distribute.

WHen You use torrent You are sharing and it is not legal I already said that like 10 times. When You download from direct links, or Youtube kinda sites it is legal even if the material is copyrighted.

Want real life example? Your browser download everything You see on Your screen 24/7 and most of that is copyrighted...and quess what. You are NOT stealing. Because it is for your own use, and You will not share that material. If You do however unathorized share that material then it is no longer legal, and then when You share You are stealing. But for Your own use You can make as many copies as You like - it is legal as long as it is for You only.

Once again You can download whatever You like as long as You dont share it and since torrents automatically share they are not legal.

I cannot make it any simpliers, if You still dont understand... Well, what can i do...
