From what I've read about the last Batman film; Bane exploded Blackgate and let all the prisoners out except for the Joker, his cell is welded shut. He's seen yelling and pleading to be let out
This is the official explanation from the novel:
“Now that the Dent Act had made it all but impossible for the city’s criminals to cop an insanity plea, it [Blackgate Prison] had replaced Arkham Asylum as the preferred location for imprisoning both convicted and suspected felons. The worst of the worst were sent here, except for the Joker, who, rumor had it, was locked away as Arkham’s sole remaining inmate. Or perhaps he had escaped. Nobody was really sure. Not even Selina.”

I dont think he dies in jail but the "solution" makes no sense, i can see this from two ways:
This is the reason people often ignore the novelizations take, because it makes no sense

@Stormbox: Of course it didn't happen, I also saw the movie. But I READ that Joker being locked away whilst everyone else played in Gotham was IDEA Nolan had and was going to explain his lack of prescence

Of course Nolan wasn't going to mention the Joker because it's just a bad move when you have to replace a tragic actor with someone else. They'd have had actors who could have easily done it - Tim Roth would have been my bet - but considering it was his last film in the trilogy with a new set of villains, they simply didn't need to address Joker at all. Therefore I dont think about what might be in the fictional Gotham, whether he be locked away in solitary or sent elsewhere to carry out his sentence of insanity.
I think if Nolan's Joker is still up and about. He'd escape encounter the new Batman John Blake, and after fighting with him be able to recognize that he's not the real Batman then, leave and disappear for a while trying to find the real Batman.

Him being executed would make more sense as he was basically a terrorist.
Out of respect Nolan never mentioned The Joker and let it become a mystery.

Oh, the possibilities. Let's see: perhaps executed by the state, perhaps Arkham's last and now sole inmates. Even a fan rumor that's he's in Guatemala bay prison for being a terrorist. Oh well. If the man's going to have an outcome...he'd, uh, prefer it to be multiple choice
I think if Ledger wouldnt of died he prolly would of had that part as the judge in the Dark Knight Rises instead of Scarecrow.
I would just assume that the Joker escaped and is just somewhere out in Gotham or he stayed in Arkham the whole time.
If Ledger hadn't died Joker would have been one of the main characters in the 3rd movie, he'd probably have ended up being more important than Bane. Just look at how he has basically been the lead villain in every single Arkham game.
He flew away on a poptart cat that poops rainbows and and he flew away to a distant land and lived happily ever after
