To be fair 3 of them havent been dead that long so they maybe back. and Original captain marvel has been back as a ghost hasnt he.

True, the last three died quite recently.

Bringing back Uncle Ben and the Waynes would pretty much negate the existence of Batman and Spider-Man IMO. Also don't forget to add Gwen-Stacy in this list.

Technically, Cable has already died & come back.  He was believed dead at the end of X-Cutioner's Song.   
 
And I thought Captain Marvel was one of the Dead Avengers...  Sorry :) 
  
But Tag, Icarus & a lot of the Xavier Institute students have stayed dead ;)

The original Crimson Avenger, Lee Walter Travis has been dead since 1981.  @joshmightbe: Uncle Ben, Jor-El, and The Waynes don't count.

Also Orion wasn't resurrected in the end of Final Crisis like the other New Gods as Darkseid wasn't too.

Ares been back as well, well, he was still 'dead' but it hasn't stopped him appearing in new stories in Secret Warriors and Chaos War. Under that specification you could just pretend all characters are dead and haven't come back. I mean if you want to lol Cap marvel appeared a few time in random old stories too, as an essence or something else, before Dead Avengers too. I think Tom Brevoort said that even the Ultimate point character for the rule for staying dead Uncle Ben could be revived given the right pitch and story even if just temporarily.
