If there was a superhero registration act introduced into the DC universe, who do you think would champion it? I'm presuming that Superman would remain neutral and Batman would be heading the anti-registration side.
Superman: Dead. If Superman were alive or present on earth the war would never happen, he has the power to shut it down both politically and with force. As someone who values a secret identity and understands its benefits Clark would never allow exposure of others and would fight for heroes rights in a vocal and physical arena. With Superman being on the anti side most heroes would follow in his footsteps as he is seen as the best of heroes.
Therefore if you want a DC CW Kill him or throw him into the phantom zone, have the pro force say "Superman would be alive if this system were in place or, if Superman were here he would agree with us." This would mean you get a nice even split among the hero community on both sides.
