Now, before you go calling this spite, there's only one combat round and it's heavily in favor of Burke. Now, on with the thread...

Round 1. The Legate sits in an empty tent in his camp, unaware that every Legionary there has been silently assassinated. Mister Burke, game mechanics aside, now has to sneak attack Lanius and survive the encounter. He starts from outside the tent, with Lanius facing away from the entrance.

Round 2. Who's the better Leader? Is the Legate, who has no love for the legion and no respect for covert tactics and prefers to pave his way by throwing countless soldiers at his target a better leader than Burke, who uses his army of mercenaries to ravage the wasteland and keep it a lawless, disorganized place?

Round 3. Who's more badass?

Bonus Round: Turns out Burke is a frumentarii. With Caesar dead of a tumor, there's a power struggle between Lanius and Vulpes. Can the Frumentarii, Burke included, with all their assets, destroy the disorganized Legion under Lanius' command?

@darthaznable: @joygirl: Eh, reasons? You may be underestimating Burke here..... And in the bonus round the Frumetarii are allows to use their assets.... Talon Company being one..... Omertas...... Tenpenny Security/Ghouls...... White Glove Society...... White Legs..... Not to mention scores of legionaries. And they don't care about honor. They'll use stealth and underhanded tactics to destroy their enemies.

@trickshot: Legate ran through NCR like they were nothing. Burke did nothing in F3 besides be pimpin. He has no combat feats and if you look at his wiki, his skills are subpar too. Not to mention he only wear a suit while Lanius is decked out in armor.

@darthaznable: Game mehcanics aside as stated in OP. And his stealth feats were great enough to allow him to infiltrate a ghoulified Tenpenny Tower, and pull a gun on Lucas Simms. Combat wise, all his feats are stated in dialogue, but he is pretty badass when you get down to it. And only one round is combat.

Leadership, Badassery, and bonus are still on the table

@trickshot: Leader round: Legate is able to strike fear into arguably the most ruthless, violent, and most powerful groups in New Vegas, Caesar's Legion. His troops both respect and fear him. Burke while mysterious, wouldn't be able to replicate that. He has done anything to really show that he could. If Legate is leader, he kills everyone at the Vegas Gates, crucifies Arcade and some other characters, and whips out the Followers group. The NCR is even afraid of him. That says something.

Badass round: Just look at him. Burke has a really good voice actor and script though. I'll say tie just because.

Bonus Round: I doubt he's close to being strong enough to take out Legate. Dude soloed an army. The frumentari are small in number compared to the rest of the Legion.

@darthaznable: it's not JUST frumentarii against legion. There will be some legion who prefer to follow the smart guy.

And Lanius took down an army? Last time I checked, he was taken down and had his face ripped off by hidebarks after killing 15 tribals who had become soft and weak due to beig under Lanius's protection. While killing 15 warriors is impressive, it is most certainly not an army.
