Marvel Handbook says that Kilgrave's power is based on pheromones, but the fact that Doom was able to use him to take over the world suggests it's more likely telepathy. The scans are helpful. It could be argued that Doom's training in sorcery in addition to his will, helped him succeed. Kingpin is probably the more useful scan for purposes of this match.
Fisk was expecting Purple Man, which may have helped. Kilgrave also told Fisk to kill himself, which is something he would instinctively resist. If he had tried something milder, say: "Let me go and forget I was ever here" that might have been harder.
Batman does have a dynamic will and a good history with breaking mind control. I don't think he could just shrug off Kilgrave's influence without struggling, but I think he could break it. If Kilgrave played it smart and gave Batman little nudges ("I'm not a criminal," "I'm one of the good guys," "The Joker has trapped hostages in this bank vault, we need to open the door before they suffocate.") he might be able to keep it going for a while. But if he told Batman to kill himself, or to stand there and let himself (or an innocent) be killed, or something like that, I think Batman would break the control.
This could make for an interesting story. Kilgrave could run out onto a crowded street and tell everyone to "Kill Batman" or "Commit suicide" and Batman would be so distracted he could get away.
Ultimately though, Batman is going to figure Purple Man out, break his control, and put him away.
