I think they are saving his character. They know people like him, but haven't really evolved his backstory or defined his capabilities. Is he a telepath? There is equal information to argue either way. The suggestion that his power is not infact telepathic in nature, is the only worthwhile reason for this to have not been explored further, or to intentionally raise such doubts in the first place. Therefore, he is not a telepath. This would make him more OP than he already is. This suggests to me he is currently benched until his uniqueness can be better explored and the overpowered nature of his talents can really be tested on a grander scale.
I do have a theory though regarding his/EVA's abilities. First, they don't communicate telepathically. One of Fantomex's sweetest pieces of gear are the telepathy blocking plates. They are one of the few things about his character that have a defined limit (or rather no limit at all): impenetrable. If there was a 'hole' or 'backdoor' for him to communicate with EVA, other telepaths would have found it. I mean, they must imagine it's there, same as the reader that assumes they are communicating through telepathy. They can't find it, there is no 'hole'/'backdoor', Fantomex is not a telepath. Then what is going on?!
Well, let's investigate his two other primary powers, before I explain my theory that these are all facets of ONE power.
Misdirection. Occasionally, referred to as illusion for more natural dialogue, but more often than not the writing is very careful to differentiate this power from others. Misdirection. Misdirects. It's kinda clunky to refer to it that way. Is it sleight-of-hand? No, it's more than that. We know this, because it is intentionally written for the reader to understand this difference, just as it is intended that we understand it is neither magic or a telepathic force. Then what is it?!
His ability to instantly read people and powers. Some of this has been touched on as him simply being very clever, very experienced, and gifted with '3 brains', but is a dubious explanation for this power at best. One cannot INSTANTLY know a situation at the moment the situation materializes due to cleverness, experience, or brain-power. That's not cleverness, or experience, or indicative of super-intelligence which would still have to move from Point A to Point C through B regardless of how fast such cognition can take place. For Fantomex, it's more akin to Precognition. We will call this Insta-cognition. In any moment immediate to him (literally, in the same moment) he can make the cognitive jump from A to C bypassing B altogether. His instacognition also explains his third power which is his deft h2h/precision aiming.
Ok, now for the theory as to the secret of Fantomex's powers, or rather, EVA's powers: Quantum observation. Fantomex can communicate with EVA, seemingly telepathically, because their consciousnesses are quantum entangled. This was the state she created when she 'bonded' with him. It is also the reason he can instacognit a situation. EVA actually does this for him, but for intents and purposes, Fantomex and EVA are one and the same. While he can't see into the future, he is instinctually 'aware' of a finite number of infinite states at any particular instant (his 3 brains were probably a reason EVA chose him or he was chosen for her) and can react in a best-possible-outcome sort of way. He probably does not himself understand the nature of this ability, which is something that EVA would make sure of, as his conscious consideration\observation of these quantum states, effects the quantum states, and ultimately defeats the purpose of instacognition anyway.
Lastly, Misdirection, is really the ability to briefly force a nebulous quantum state by intense observation of an instant, and all possible instances of that instant, BEFORE it happens. Fantomex and EVA can literally manufacture reality. It seems to be quite taxing for them to do so, and as to how much reality bending/manufacturing they can really accomplish and on what sort of scale, amounts to little more than a convincing illusion once the switch is flipped back on, so to speak, and reality reasserts itself. His 'illusions' are not illusions at all. They indeed were real...you know...before they never happened :).
