I think it should have stayed dead. We need new heroes to arise, Cap has had his time to shine. I should have known he wouldn't truly die, that someone would take up his mantle.

Okay well, firstly the only problem I have with the costume is its a bit shiny, and the point near the stomach if it is indeed a chrome like stub stance of metal, wouldn't that hurt to bend? Otherwise its not that bad, its pretty close to the original at any rate, and my bets are on Bucky being Cap. I'm more or less just interested in the story present on a new Cap and how people will react, etc.

As for all the Iron Man bashing I cant believe people on forums these days, Tony is a really well written character, he isnt a douche or anything of the sort. He saw the alternates and took the lesser evil and is trying to prevent anything worse from occurring, if you even read his comics you'd understand that (which are really good, I am really enjoying the Knauf writing team.) I agree with Donnieman v5.1 most comments make me laugh at how ridiculous some Iron Man bashing is.

He was for all of an hour during Fallen Son, but after he went after Hawkeye and Patriot, who ripped on him for dressing like Cap, but not being Cap (He retalliated by questioning Kate on using Hawkeye, who told him it was to honour the dead, not be Hawkeye). Clint gave Tony the costume and shield back after that, saying it wasn't right for him to do that.

I think it's Bucky.

I just don't think Brubaker would make it that obvious. I'd like it to be Bucky but I don't think it will. Stark got that letter from Steve (supposedly) that said to keep "Captain America" alive. It'll probably be some SHIELD shmoe. You know it probably won't last so they probably won't make it someone really cool. Also from the pics, the jaw doesn't look like Bucky's.

As for the Iron Man issue....

Tony Stark is a smart man, I'll grant that. The trait that makes him compelling as a character, however, is the fact that he cannot resolve or rationalize the twin facts that he is an imperfect being, and a world revolutionizing genius at the same time.

Ultimately, though... he's not a hero anymore. He's lost his integrity... and it isn't the fact that he backed Registration that did it.

It was the fact that he was willing to sacrifice liberties for securities. The Registration Act was controversial, yes, and arguably wrong... but it was the law. As the law, it was possible that it may be repealed, reconsidered, or rendered irrelevant as public opinion turned. It stopped being the law the instant Stark decided that it was appropriate to throw those who refused to register into a trans-dimentional internment camp without legal representation, a day in court, or even a vague semblance of due process. When that happened, the SHRA stopped being the law and started being Stark's Law. It stopped being about what was legal, and started being about Iron Man ramming his superior judgment down everyone else's throats.

Legally, Federal Law is supposed to be extremely limited in what it can effect. I believe the precise limitation is interstate commerce. Even this is arguably irrelevant... lots of Federal laws are on the books these days that don't deal with commerce between the states without being struck down by judicial review.

However, Stark and Richards chose to discard due process in the enforcement of the SHRA... and it wasn't directly comparable to the historic Civil War. The majority of the anti-registrants were not renouncing their citizenship. Because they were choosing to be criminals rather than defectors, the anti-registrants remained legally entitled to due process and legal representation. They remained entitled to speedy trials with juries of their peers. From a political and legal standpoint, their own actions compromised the legality of the SHRA.

I can't blame all the characters in the Marvel universe for believing that Stark might have set up Cap's assassination. All it would take to strike down the SHRA would be a steady cycle of court appeals to bring the matter before the Supreme Court, and sufficient witness testimony regarding the law's unconstitutional enforcement to have it removed from the books.... and even in defeat, Cap had more than enough grassroots support to fund a lengthy legal campaign. Politically, Captain America was more dangerous to the Superhuman Registration Act after his surrender than he could've ever hoped to be beforehand.

That said, while Stark might be manipulative enough to do that, and he might be canny enough to do that... I don't think he'd have it in his heart. Stark's support of the Registration Act is based in misplaced good intentions... and even if those good intentions could rationalize imprisoning super humans, they couldn't rationalize murdering a man after he's submitted to the mercies of justice. Iron Man might not be a Hero right now... but he was once, and he might be again one day. We can hope.
