The question isn't why Batman haven't kill joker but why the police and court haven't killed the Joker.

Because only Batman is smart enough to defeat him.

What does that have to do with Batman defeating him? Batman criminals to the cops, if he starts killing criminals then cops will hunt him down. Its courts responsibility to condemn Joker to death.

I told you only Batman is able to defeat him. Any cop would get killed trying to kill him or just trying to get close to him. Joker is smart enough to circumvent Extreme Prejudice.

@pcn24454: I meant when they catch him with the help of Batman the court should order death penalty.

Because then Joker would have won, proving the point that one bad day can push one man to his limits. Haven't you read The Killing Joke?

This is correct. Joker wants Batman to kill him. If Batman kills Joker he is no longer a hero and the Joker wins.

The OP's logic can be applied to nearly every hero. Luthor has killed like 90 000 Kryptonians. If we apply his logic to Superman he is a genocidal maniac responsible for all those deaths.

I agree with this. Also what if the court condemns him to death? Then Joker loses!

    - Except it's not nearly the same with every hero at all.

    - You must think that Lex would be running free after killing louis, jimmy, and Clark's parent's?

    - Clark is a much better hero than Bruce as he will actually put people away in a place that isn't a revolving door.

    - Also, if the Joker keeps on living he continues to win. If you kill him, he may "win" once however, it's over. He won't be killing anymore. By letting this idiot live, Bruce along with the U.S. government are the real criminals in the DCU and gotham will never be safe. Hence, Bruce claims to be protecting gotham and yet, he's the reason it's in peril.

    - Moreover, throughout all of Snyder's fatuous and inane drivel, this is one of the few things that i agree with him about.

The justice system is a damn joke in comics lol it's more on the "invisible" legal system that keeps detaining him instead of put him on death row, or having a pissed off police officer or judge arrange for him to be quietly put down. I think it would be more powerful in a comic story if you had a scene where bats and joker are fighting and as joker is about to get the upper had a NORMAL GOTHAM citizen empties a clip into joker reloads and empties it into him again. This is awesome because it will have so much of a ripple effect in Batmans world, an average citizen fed up with his lack of killing him, and the citizen is tired of being subjected to te Jokers maniacal ways never know in when he might be another random victim tha is to Batmans negligence. I think it would be an interesting soul searching arc for batman.

So all the crime in the wolrd is because the cops dont kill the criminals, if the cops killed the criminal would mean no crime.

Wow you must be the most brilliant human being that had ever live, i was being sarcastic.

If you dont understand the why, you have serious problem kiddo.
